Shellfishermen File Suit Against Feds Over Oil Spill

As crews frantically work to clean oiled beaches before Memorial Day weekend, a Michigan lawyer representing shellfishermen crippled by last month's Buzzards Bay spill has filed suit against the federal government.
Attorney Dennis M. O'Bryan of the Fishermen's Legal Network had originally sued Bouchard Transportation after one of its barges leaked 98,000 gallons of oil into Buzzards Bay April 27.

As the J.W. Westcott II filled with water and started sinking last October, the two freighter pilots on board took one last gulp of air and pushed their way out the sliding cargo door and floated to the surface.
In the eerie predawn darkness on the Detroit River, the two bobbed in the 53-degree water and watched the 44-foot boat slowly slip bow-first underwater as its propeller furiously spun in the air. The boat's captain and deckhand drowned.

The owner of the towboat whose barge collapsed the Interstate 40 bridge near Webbers Falls has asked a federal court to limit its liability.
The injured and the families of the 14 people killed in the May 26 bridge collapse would be unable to receive more than a combined total of about $1.2 million for their losses if a judge approves the petition filed Monday by Magnolia Marine Transport Co.

A Tennessee barge company will pay $10 million to a Wheelersburg, Ohio, man who suffered serious head injuries while working on an Ohio River barge.
The Ingram Barge Co. agreed to the out-of-court settlement Tuesday in U.S. District Court in Covington.

DETROIT -- The brother of a man missing since the sinking of a mail delivery boat he worked on is suing the company that owns the boat.
The J.W. Westcott II went down in the Detroit River on Oct. 23. The body of Catherine Nasiatka, 48, of Algonac was recovered Monday, but deckhand Dave Lewis, 50, of Royal Oak, has not been found.

DETROIT -- The family of a missing crew member of the J.W. Westcott II has filed a $10-million federal lawsuit against the company, accusing it of negligence in the Oct. 23 sinking of the Great Lakes mail boat.
The brother of David Lewis, 50, of Eastpointe filed suit against the J.W. Westcott company in U.S. District Court. Lewis's body has not been found. On Monday, the body of 48-year-old Catherine Nasiatka of Algonac was discovered on the boat.
